Delivery terms
When purchasing or returning the Goods, the Buyer shall bear the cost of delivery by courier or parcel post. The Buyer may also return the Goods by hand delivery to the office at Lielā iela 2, Talsi, LV-3201.
1. DELIVERY CONDITIONS
1.1 The standard dispatch time for purchased goods is 1-3 working days.
1.2 For the delivery terms of the goods, the Buyer may refer to the information available at www.omniva.lv, pasts.lv and www.dhl.com/lv-lv/, which may vary depending on the months of the year and the busyness of holidays.
1.3 The Seller shall be responsible for preparing the Goods for delivery. The Seller shall not be liable for any delay in delivery caused by circumstances beyond the control of the Seller, including congestion of Omniva SIA, Latvijas Pasts VAS or DHL Express Latvia SIA.
2. EXERCISE OF THE RIGHT OF WITHDRAWAL
2.1 The Consumer shall have the right to withdraw from the Goods within 14 (fourteen) days of receipt of the Goods without giving any reason. The period for exercising the right of withdrawal expires after 14 (fourteen) days from:
* from the date of delivery of the Goods;
* from the last date of delivery of the Goods - if the order includes several Goods;
* from the date of delivery of the last batch or part of the goods, if delivery is made in batches or parts.
2.2 In order to exercise the right of withdrawal, the Buyer must send to the Seller a completed withdrawal form or an express free-form notice containing details of the Goods purchased, the Buyer's name (for natural persons), name, registration No. and registered office address (for legal persons), telephone No., bank account No. from which payment for the Goods was made and email address.
2.3 In order to comply with the withdrawal period, the Buyer must send its notice of exercise of the right of withdrawal before the expiry of the withdrawal period or on the last day of the withdrawal period before 12am.
2.4 During the period for exercising the right of withdrawal, the Buyer shall be entitled to use the Goods to the extent necessary to test their nature, characteristics and performance (to the same extent as would have been possible before the Goods were purchased in a normal shop). In exercising the right of withdrawal, the Buyer shall be liable for any use of the Goods which exceeds the time and manner prescribed for the purpose of testing the nature, characteristics and performance of the Goods. The Buyer shall be liable for any use of the Goods during the period of exercise of the right of withdrawal which is incompatible with the principle of good faith and for any diminution in the value, quality and safety of the Goods.
2.5 After the Seller has received the Buyer's notice of exercise of the right of withdrawal in the manner and within the time limit set out in the Contract and the laws and regulations, the Seller shall inform the Buyer thereof. Within 10 (ten) days after receipt of the relevant confirmation from the Seller, the Buyer shall deliver the Goods and the proof of purchase (bank payment order) to the Seller's sales/delivery point at 2 Lielajā Street, Talsi, LV-3201 (courier and/or postage costs shall be borne by the Buyer), using postal/courier services or in person
2.6 The original of the Refusal Form shall be sent to the office at Lielā iela 2, Talsi, LV-3201 and a scanned copy sent to the Seller's e-mail: info@verdins-watches.com.
2.7 Upon receipt of the withdrawal form, the Seller shall, without undue delay, but no later than within 14 (fourteen) days from the date of receipt of the returned undamaged, clean Goods from the Buyer, refund the amount paid by the Buyer to the bank account specified by the Buyer. If the Goods are returned due to the Buyer's change of mind or incorrect choice (difference in formats), the Seller shall be entitled to retain the shipping costs, and if the Goods are returned to the Seller on the initiative of the shipping company (goods not collected for too long), due to the fault of the Seller (incorrect mobile phone number provided, resulting in the shipping company being unable to send the recipient access information to the Goods, or the Buyer not collecting the Goods in time, etc. etc.), the Seller shall be entitled to deduct a double dispatch charge (for the original dispatch and return) from the refund.
2.8 In the event of exercise of the right of withdrawal, the Buyer shall not be liable for the cost of remittance if it is a domestic remittance. If the funds transfer is to another country, the costs shall be borne by the Buyer. The Seller shall deduct the transfer costs from the amount to be transferred to the Consumer.
2.9 The right of withdrawal shall not apply to Goods which have opened packaging and which cannot be returned for health and hygiene reasons.
